Welcome to Flat Fee Select. These Terms of Use govern your access to and use of the Flat Fee Select website, forms, content, communications, and related online services.

1.Flat Fee Select’s Role

Flat Fee Select is a broker-guided flat-fee listing service for residential home sellers. The website is intended to provide information about our listing model, allow prospective sellers to request information, schedule consultations, submit property details, and learn about available real estate listing services.

Unless and until a written listing agreement or other required brokerage document is signed by all required parties, use of this website does not create a brokerage relationship, listing agreement, agency relationship, fiduciary relationship, or obligation to provide real estate services.

All real estate brokerage services are provided through a licensed Florida real estate brokerage.

The information on this website is for general informational purposes only. Flat Fee Select provides real estate brokerage-related information and listing-service information.

Flat Fee Select does not provide legal, tax, accounting, financial, lending, title, insurance, inspection, engineering, or appraisal advice. You should consult the appropriate licensed professional for advice about your specific situation.

3.Brokerage Relationship Disclosure

Any brokerage relationship will be determined by the applicable Florida brokerage relationship disclosure, listing agreement, and brokerage documents.

Unless otherwise agreed in writing, any brokerage relationship, duties, and obligations will be governed by Florida law, the signed listing agreement, and applicable brokerage disclosures.

No brokerage relationship is presumed unless one is established in writing in accordance with Chapter 475, Florida Statutes. Use of this website alone does not establish a transaction broker relationship, single-agent relationship, or other brokerage relationship.

4.Eligibility

You must be at least 18 years old to use this website or submit information through our forms.

By using this website, you represent that: (a) you are at least 18 years old; (b) the information you provide is accurate and complete; (c) you have authority to submit information about the property; and (d) your use of the website complies with applicable law.

5.Website Information Is Not a Guarantee

Flat Fee Select may provide examples, educational content, pricing illustrations, commission comparisons, savings examples, process explanations, and market-related information.

These materials are for informational purposes only and do not guarantee a sale, sale price, specific number of showings, specific number of offers, specific timeline, specific net proceeds amount, appraisal approval, inspection results, buyer financing approval, or closing.

Savings examples are estimates only and may depend on assumptions such as sale price, commission structure, buyer-agent compensation, seller concessions, closing costs, repairs, and other transaction-specific factors.

6.Flat Fee Select Pricing Information

Flat Fee Select’s advertised pricing may include an upfront fee and a closing balance.

Unless otherwise stated in a signed agreement, the current Flat Fee Select structure is: $595 upfront fee; $3,000 closing balance due only if the home sells through Flat Fee Select; $3,595 total Flat Fee Select listing fee.

The $595 upfront fee is an earned upfront fee when paid. It covers listing setup, broker time, administrative processing, marketing preparation, photography coordination, MLS preparation, and other work or costs incurred before launch.

The remaining $3,000 balance is due only if the home sells through Flat Fee Select, subject to the signed listing agreement, service agreement, protection period, or other applicable written agreement.

Website pricing is informational only and may be subject to change, eligibility, market availability, brokerage approval, MLS requirements, and written agreement terms.

7.Seller-Controlled Showings

Flat Fee Select uses a seller-controlled showing model. Sellers are generally responsible for approving showing availability, managing property access according to agreed showing instructions, securing personal property, and maintaining the home in showing-ready condition.

Flat Fee Select may assist with showing strategy, buyer and agent inquiries, offer review, negotiation guidance, and transaction coordination, but seller responsibilities will be governed by the applicable listing agreement and service documents.

Sellers must comply with all Fair Housing laws and may not impose discriminatory showing restrictions, communication standards, buyer preferences, or offer-review criteria.

8.Buyer-Agent Compensation and Concessions

Buyer-agent compensation, seller concessions, closing cost credits, or other buyer-side incentives are negotiable and are not required as a condition of listing with Flat Fee Select unless otherwise required by a specific agreement, law, MLS rule, or brokerage policy.

Flat Fee Select may discuss available options, market norms, potential strategies, and possible consequences of offering or not offering buyer-side compensation or concessions. The seller makes the final decision, subject to applicable law, MLS rules, brokerage policy, and the signed listing agreement.

9.User-Submitted Information and Materials

You may submit information through the website, including contact information, property details, photos, videos, documents, notes, forms, and other materials.

By submitting materials, you represent that the information is accurate to the best of your knowledge; you have the right to submit it; the materials do not violate anyone else’s rights; and the materials may be used by Flat Fee Select and the brokerage for evaluation, consultation, listing preparation, marketing preparation, compliance, communication, and transaction-related purposes.

Seller-submitted photos, videos, or walkthrough materials may be used for internal broker review, property evaluation, listing preparation, or marketing only as permitted by the applicable agreement and seller authorization.

10.Property Information Accuracy

You are responsible for providing accurate and complete property information, including known defects, improvements, association information, restrictions, access details, fees, occupancy status, property condition, and other material facts.

Flat Fee Select may rely on seller-provided information when preparing listing materials. Sellers remain responsible for reviewing and approving listing content, disclosures, and marketing materials before publication.

11.MLS, Portals, and Third-Party Platforms

MLS exposure, listing syndication, portal display, and other third-party marketing features are subject to MLS rules, brokerage approval, platform availability, data-sharing agreements, and third-party policies.

Flat Fee Select does not control how third-party websites display listing information, photos, price changes, status updates, open house information, or other listing data.

Flat Fee Select does not guarantee a specific number of views, saves, inquiries, showings, offers, sale price, or closing outcome from any MLS, portal, or third-party marketing feature.

12.Third-Party Services and Vendors

Flat Fee Select may coordinate or use third-party services, vendors, platforms, payment processors, photographers, sign / lockbox providers, CRM systems, email / SMS providers, calendar tools, MLS systems, title companies, lenders, inspectors, contractors, attorneys, or other third parties.

Third-party services may be subject to their own terms, privacy policies, availability, fees, schedules, and requirements.

Flat Fee Select is not responsible for third-party platform outages, vendor delays, portal display issues, MLS system delays, payment processor issues, or third-party errors outside of its control.

13.Communications, Email, Phone, and SMS Consent

By submitting a form, scheduling a consultation, or providing contact information, you expressly consent to receive automated calls, prerecorded messages, and text messages from Flat Fee Select, the licensed brokerage, and their representatives at the number provided regarding your inquiry, consultation, property review, listing process, transaction, and related real estate services, even if that number is on a Do Not Call list. Consent to receive marketing text messages is not a condition of purchasing services.

Message and data rates may apply. Message frequency may vary. You may reply STOP to opt out of text messages or follow unsubscribe instructions for marketing emails where available.

Calls may be recorded or monitored for quality assurance, training, compliance, or customer service purposes where permitted by law.

14.Privacy

Your use of this website is also subject to the Flat Fee Select Privacy Policy.

Flat Fee Select may collect, store, use, and process information you submit through the website or related communications for purposes including lead response, consultation scheduling, property review, listing preparation, marketing, compliance, transaction coordination, and service improvement.

Do not submit highly sensitive personal information unless specifically requested through an approved secure method.

15.Acceptable Use

You agree not to use the website to violate any law or regulation; submit false, misleading, fraudulent, or incomplete information; impersonate another person; interfere with website security or functionality; upload viruses, malware, or harmful code; scrape, copy, crawl, or harvest website content through automated means; use the website for discriminatory, unlawful, harassing, or abusive purposes; submit content that violates intellectual property, privacy, publicity, or other rights; or attempt to gain unauthorized access to systems, accounts, data, or communications.

16.Fair Housing

Flat Fee Select supports and follows all applicable Fair Housing laws.

Users may not request, submit, authorize, or direct any advertisement, showing practice, communication, buyer preference, offer-review standard, transaction term, or seller instruction that discriminates based on race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other protected class under applicable law.

Flat Fee Select may decline, modify, or remove any content, instruction, or communication that may violate Fair Housing laws, MLS rules, brokerage policy, or ethical requirements.

17.Intellectual Property

The website, brand elements, text, graphics, logos, designs, icons, layouts, videos, workflows, and other content are owned by or licensed to Flat Fee Select, its owner, its brokerage, or its licensors.

You may view and use the website for personal, non-commercial purposes related to evaluating or requesting Flat Fee Select services.

You may not copy, reproduce, distribute, modify, display, sell, scrape, or create derivative works from the website or its content without written permission.

18.Feedback

If you provide comments, suggestions, ideas, reviews, corrections, or other feedback, you authorize Flat Fee Select to use that feedback to improve services, website content, marketing, processes, and customer experience without compensation to you.

Testimonials, reviews, endorsements, photos, videos, case studies, or seller success stories may only be used for marketing with proper permission and must be truthful, genuine, and non-misleading.

Nothing in these Terms limits liability that cannot be limited under applicable law or alters rights or obligations under a signed listing agreement, brokerage disclosure, or other written agreement.

You agree to defend, indemnify, and hold harmless Flat Fee Select, the licensed brokerage, owners, agents, contractors, vendors, service providers, and affiliates from claims, damages, liabilities, losses, costs, or expenses arising from your use of the website; your submitted information or materials; your violation of these Terms; your violation of law; your violation of another party’s rights; inaccurate or incomplete property information you provide; or unlawful, discriminatory, or improper showing instructions or seller communications.

24.Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the website shall be handled in the state or federal courts located in Broward County, Florida, unless otherwise required by law or controlled by a signed written agreement.
